FG Clarifies No Inmate Released Yet Under Tinubu’s Clemency Exercise, Says Process Still Under Final Review to Ensure Legal Compliance

The Office of the Attorney-General of the Federation and Minister of Justice has clarified that no inmate approved for clemency under the latest presidential pardon exercise has been released from custody, emphasizing that the process remains subject to change and is still undergoing a final legal review.

It is reported that the clarification followed public backlash trailing the recent exercise of the power of prerogative of mercy by President Bola Ahmed Tinubu on certain categories of inmates across the country.

In a statement personally signed by the Attorney-General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), on Thursday, the AGF’s Office explained that the process was currently at the final administrative stage. This phase, according to the statement, includes a standard review to ensure that all names and recommendations fully comply with established legal and procedural requirements before any instrument of release is issued.

The statement further explained that “it is important to note that the last stage of the exercise, after approval by the Council of State, is the issuance of the instrument for the implementation of the decision concerning each beneficiary.”

The Office added that “this stage affords an opportunity for a final look at the list for remedial purposes, if any, before the instrument is forwarded to the Controller-General of Corrections for necessary action.”

According to Fagbemi, the ongoing verification and vetting process form part of the government’s standard due diligence protocol, reflecting its commitment to transparency, accountability, and adherence to the rule of law.

He appreciated the public’s vigilance and constructive feedback, noting that such engagement helps strengthen institutional integrity. 

“Public engagement is always welcome, as it demonstrates that Nigerians care deeply about justice and good governance,” Fagbemi stated.

Addressing concerns of possible delays, the Minister dismissed the notion, insisting that the process was proceeding strictly according to legal provisions. 

“There is no delay in the process; it is simply following the law to the letter to ensure that only those duly qualified benefit from the President’s mercy. As soon as all legal and procedural checks are concluded, the public will be duly informed. The rule of law does not rush; it ensures fairness,” the statement added.

Recall that the Council of State had, last Thursday, ratified a list of offenders both dead and alive including those who had served prison terms and others currently on death row, presented by President Bola Ahmed Tinubu as beneficiaries of the Presidential Power of Prerogative of Mercy.

This latest clarification by the Office of the Attorney-General aims to assure Nigerians that the Tinubu administration remains committed to justice, fairness, and procedural integrity in the exercise of presidential clemency.
